IRS’s top 10 tax tips for home sellers

From time to time the IRS releases tips designed to help people with their taxes. Some of these are quite useful.

Last week the agency released “Ten Tax Tips for Individuals Selling Their Home,” (IRS Summertime Tax Tip 2011-15).

As a real estate agent or broker, it is not your job to give home sellers tax advice. Indeed, it is advisable not to, since you could end up getting sued if you give wrong advice.

Instead, refer sellers to this list of IRS tips. It’s a good starting place for them to begin to understand this often complex area of tax law. You could even print it out and hand it to anyone who asks you about these issues.

Here are the IRS’s top 10 tax tips for home sellers:

1. In general, you are eligible to exclude the gain from income if you have owned and used your home as your main home for two years out of the five years prior to the date of its sale.

2. If you have a gain from the sale of your main home, you may be able to exclude up to $250,000 of the gain from your income ($500,000 on a joint return in most cases).

3. You are not eligible for the exclusion if you excluded the gain from the sale of another home during the two-year period prior to the sale of your home.

4. If you can exclude all of the gain, you do not need to report the sale on your tax return.

5. If you have a gain that cannot be excluded, it is taxable. You must report it on Form 1040, Schedule D, Capital Gains and Losses.

6. You cannot deduct a loss from the sale of your main home.

7. Worksheets are included in Publication 523, Selling Your Home, to help you figure the adjusted basis of the home you sold, the gain (or loss) on the sale, and the gain that you can exclude.

8. If you have more than one home, you can exclude a gain only from the sale of your main home. You must pay tax on the gain from selling any other home. If you have two homes and live in both of them, your main home is ordinarily the one you live in most of the time.

9. If you received the first-time homebuyer credit and within 36 months of the date of purchase, the property is no longer used as your principal residence, you are required to repay the credit. Repayment of the full credit is due with the income tax return for the year the home ceased to be your principal residence, using Form 5405, First-Time Homebuyer Credit and Repayment of the Credit. The full amount of the credit is reflected as additional tax on that year’s tax return.

10. When you move, be sure to update your address with the IRS and the U.S. Postal Service to ensure you receive refunds or correspondence from the IRS. Use Form 8822, Change of Address, to notify the IRS of your address change.

Buyer beware of bathroom leak

Don’t expect recourse for fixing $1,500 defect

DEAR BARRY: After buying our home, we discovered a leak in the floor of our upstairs shower. The surprise came when water began dripping from the downstairs ceiling. Worse still, we discovered that the ceiling had previously been patched. This means that the sellers must have known about the problem, a suspicion that has been confirmed by the next-door neighbor.

When we had our home inspection, the inspector ran water for a while but not long enough to reveal the leak. Now we’re stuck with a repair cost of $1,500. The seller has moved out of state, and the home inspection report specifically disclaims shower pans. Do we have any recourse against the home inspector or the seller? –Jason

DEAR JASON: The sellers were apparently aware of the leaking shower pan but chose not to disclose it. On that basis, they appear to be in violation of the law and subject to legal consequences. Unfortunately, their residency in another state complicates your chances of bringing justice to bear.

For clarification of the strengths or weaknesses of your position, you can seek the advice of an attorney, but a $1,500 claim probably does not warrant the investment of legal costs.

Home inspectors typically perform their work in accordance with established industry protocol, as set forth by professional associations such as the American Society of Home Inspectors. Unfortunately, these standards do not include testing of shower pans.

Evaluating the water-tightness of a pan is generally done by pest control operators (commonly known as termite inspectors). This is because pest control operators also inspect for fungus infection, and moisture problems at showers can promote the growth of fungus.

However, pest inspectors typically omit pan tests when showers are located upstairs. The reason for this exclusion is to avoid liability for ceiling damage if the pan leaks during the test. Thus, leaking shower pans often escape detection in the course of a real estate purchase. In many cases, unwitting buyers are unfairly saddled with the costs of repair.

DEAR BARRY: The home we are buying is brand-new, so we haven’t decided whether we should hire a home inspector. If we do hire someone, are there inspectors who specialize in inspection of new homes? –Calvin

DEAR CALVIN: All home inspectors inspect brand-new homes, but it is unlikely that any home inspectors limit their business exclusively to new construction.

If you are wondering if a home inspection is recommended for brand-new homes, you have apparently not followed this column. In short, the critical importance of inspecting brand-new homes cannot be overemphasized. It is an essential absolute for buyers of new homes.

Rather than repeating what has been explained in past articles, let me underscore this unvarying fact: All brand-new homes have defects. It just takes a qualified, experienced home inspector to identify the glitches.

Once you have the report in hand, the builder makes the appropriate corrections. This is better than having someone else’s home inspector finding the defects when you eventually sell the property, years from now, after the builder’s warranty has expired.

8 steps to fixing a leaky faucet

Q: The cold-water faucet in my shower has developed a continuous drip. I’ve never tried to change a washer in a faucet before. Should I try to do it myself or call a plumber? Is it only a matter of turning off the main water supply, then taking the faucet apart to find the washer to replace, or is it more complicated?

I don’t know the make and model, but the faucets have been here since before I moved in more than 20 years ago.

A: Nearly all modern showers have a single mixing valve that combines hot and cold water. You have the old-fashioned type, meaning you have to adjust the hot and cold separately.

This is something you can and should do yourself. You can take an hour of your time and 75 cents in parts or call a plumber and receive a bill for around $100.

Here’s the step-by-step process to change a washer:

Step 1: Turn off the water to the house. In temperate areas, exterior pipes do not freeze. The shutoff valve is usually where the water line enters the house. In 20-plus-year-old systems, the valve is usually a gate valve with a round “wagon wheel” handle. There’s usually a hose bib immediately above it. Close the shutoff valve, then turn the hose bib on to release water pressure from the system.

Step 2: Turn the hot and cold tub faucets on to drain water from the valve.

Step 3: Close both valves, then reopen them about halfway.

Step 4: Spread a towel or washcloth over the drain so as not to lose any small parts. With a Phillips-head screwdriver, remove the screws from the hot and cold handles and take the handles off. Put the screws in a safe place.

Step 5: Remove the chrome escutcheons by turning them counterclockwise. They should be screwed on only hand-tight, but they may be stuck. If so, use a pair of channel-lock pliers, placing a towel or washcloth between the teeth of the pliers and the escutcheon so as not to mar the chrome.

Step 6: With the handles and escutcheons removed, the spindle is exposed. The spindle is the part of the valve that regulates water flow. At the far end of the spindle is a rubber washer that, when tightened against a metal seat, stops the water flow.

Remove the bonnet nut so that the spindle can be removed and the washer replaced.

The bonnet nut is probably below the surface of the tile, making it impossible to get purchase with a normal wrench. There is a special socket wrench solely for this purpose that is inexpensive and available at any local hardware store.

It may be necessary to remove some grout or cement to get at the bonnet nut, even with this specialty tool. Tap lightly on the grout with a screwdriver and hammer to free the area around the nut. Again, after 20 years, the nut may be stuck. Spray on a little Liquid Wrench or WD-40 to loosen it. Then remove the bonnet nut.

Step 7: To remove the spindle, replace the handle and turn clockwise until the spindle is free of the valve.

Step 8: At the end of the spindle will be a screw holding the washer in a seat. The washer will probably appear flat, but the new one will most likely be cone-shaped. Take the spindle to your local hardware store and the folks there should be able to set you up with the correct washer. Alternatively, buy a pack of assorted rubber washers and find the one that fits in the seat. Remove the screw holding the old washer and replace the old with the new.

Reverse these steps to get the tub back in operation.

Oh, and while you’re at it, change both the cold and hot washers. Sure as shootin’, as soon as the cold leak is fixed, the hot one will go.
